Rideshare claims are built to confuse you. We’re built to win them.

After an Uber or Lyft crash, three different insurance companies can be involved: the driver’s personal carrier, the rideshare company’s commercial policy, and your own. Each one has a reason to say the other should pay. At AJ Hall Injury Law Team, your case stays with three people whose names you’ll know, and we make the right policy pay.

An in-house Medical Professional

Dr. Rolando Contreras personally reviews your medical records and quantifies the full extent of your injuries, including the ones insurance companies routinely undervalue. Most Arizona PI firms simply don’t have this capability on staff.

3

A three-person team that knows your name

You won’t be case #4,872. Arthur personally oversees every strategy, Alfred serves as your bilingual day-to-day contact, and Dr. Contreras handles records and injury documentation. The three of us keep you informed at every stage.

We know the coverage tiers cold

Which policy pays depends on what the driver’s app was doing at the moment of impact. We pull trip records, lock down app data before it disappears, and pin the claim to the policy that actually owes you.

Who pays depends on the app.

Arizona law (A.R.S. § 28-4038) sets minimum rideshare insurance coverage for each stage of the driver’s app activity, and Uber and Lyft’s own policies typically meet or exceed those minimums. Which stage applied at the moment of the crash is the single most disputed question in every Uber and Lyft case, because hundreds of thousands of dollars in coverage can turn on one timestamp.

Driving for themselves

The app is off. The driver is legally just a regular driver, and their personal auto policy is the primary coverage.

Personal policy only

App on, waiting for a request

The driver is logged in but hasn’t accepted a ride. Uber and Lyft provide smaller contingent coverage if the driver’s personal policy won’t pay.

Typically $50K / $100K injury

Ride accepted, heading to pickup

From the moment the driver accepts a request, the rideshare company’s commercial liability coverage takes over.

Up to $1,000,000 liability

Passenger in the vehicle

The highest coverage tier. It protects passengers and anyone else the driver injures, until the passenger exits the vehicle.

Up to $1,000,000 liability

Not sure which period applies to your crash? That’s our job, not yours.

Tell us what happened and we’ll identify every policy in play. The consultation is free with no obligation.

What to do after a rideshare accident in Arizona.

Most of the usual crash advice applies, but rideshare cases add one thing regular accidents don’t have: app data. The trip record is the strongest evidence of which insurance tier applies, and it’s easier to preserve in the first days than to fight for later.

1

Get medical care, even if you feel fine

Adrenaline masks pain after a crash, and soft-tissue and head injuries often hide symptoms for 24-72 hours. Going to urgent care or the ER creates the medical record that ties your injuries to the crash.

2

Call law enforcement and file a report

If there’s any injury or property damage, Arizona law requires drivers to remain at the scene and notify police. Make sure the report notes that a rideshare vehicle was involved. Never leave without a report.

3

Screenshot the trip in the app

If you were the passenger, screenshot the trip screen, driver name, license plate, and receipt before the ride disappears into your history. This is the timestamped proof of which coverage period applies. If you were hit by a rideshare driver, photograph their phone mount or trade information showing they were on the app.

4

Document everything else

Photos of vehicle damage, the scene, road conditions, and your injuries. Names and numbers from witnesses and every driver involved. In a rideshare crash there are usually more people at the scene than a normal wreck. Every account helps.

5

Report the crash in the app, but keep it factual

Uber and Lyft both have in-app crash reporting, and reporting creates a record that the company knows about the incident. Keep it to the basic facts: where, when, vehicles involved. Do not describe your injuries or accept any blame. Save the details for your attorney.

6

Call an attorney before any adjuster gets you on the phone

Rideshare claims bring out large third-party insurance administrators whose first offer is fast and low. You generally have two years from the date of the accident to file (A.R.S. § 12-542), but app data and dashcam footage can vanish in weeks. The consultation costs nothing, and preservation letters go out immediately.

Rideshare accident cases we handle.

If a rideshare vehicle was involved in your crash, in any seat or from any angle, there’s a version of this claim we’ve handled. Every case gets the same hands-on approach.

Injured Uber & Lyft passengers

You trusted a stranger’s driving and got hurt. Passengers are almost never at fault, and the coverage designed for you is the largest tier. We make sure it pays what it should. Read our passenger guide.

Drivers hit by a rideshare vehicle

An Uber or Lyft driver ran a light or rear-ended you. Depending on their app status, the company’s commercial policy may owe you far more than a personal policy would.

Pedestrians & cyclists

Rideshare drivers watching a pickup pin instead of the crosswalk hit people. The same tiered coverage protects pedestrians and cyclists, and we know how to reach it.

Rideshare drivers hit by others

If you drive for Uber or Lyft and another car hit you, your claim can involve the at-fault driver’s policy, the company’s contingent coverage, and UM/UIM. We sort out the stack.

Hit-and-run & uninsured drivers

If the at-fault driver fled or carried no insurance, uninsured motorist coverage usually applies, including UM coverage on the rideshare policy in many on-trip cases. We file it correctly so it isn’t denied on a technicality.

Delivery app drivers & victims

UberEats, DoorDash, and other delivery platforms carry different, often thinner coverage than rideshare. If a delivery driver hit you, or you deliver and got hit, the policy math changes. We handle those cases too.

The team that will handle your case.

You won’t be passed between strangers. The three of us handle every case from start to finish.

Arthur J. Hall

Reviews all medical records in-house and provides detailed analysis of your injuries. He bridges medical treatment and legal advocacy, a role most Arizona PI firms don’t have on staff.

Alfred Valdez

Paralegal · Bilingual

Your day-to-day point of contact, bilingual in English and Spanish. Alfred manages communication with adjusters and keeps you updated through every stage of your case.

Client Experiences Shared

What working with us actually looks like.

No mystery, no surprises. Here’s exactly how a rideshare case moves from the first call to a resolution.

Free consultation

Tell us what happened. We listen, ask questions, explain what you’re entitled to, and tell you honestly whether you have a case. No pressure, no fees.

Evidence + app data preservation

Preservation letters go out to Uber or Lyft immediately so trip records, app status, and driver data can’t quietly disappear. We collect the police report and witness statements.

Medical review + valuation

Dr. Contreras reviews your medical records in-house so the full extent of your injuries is documented. Then we identify every policy in play and put a real number on the case.

Negotiation, settlement or trial

Arthur negotiates directly with every carrier involved. Most cases settle, but if the insurance companies won’t be reasonable, we’re prepared to go to court. You pay nothing unless we recover.

Compensation we fight to recover.

A rideshare crash costs more than what shows up on the first hospital bill. Arizona law allows you to pursue compensation for every category of loss the crash caused.

  • Medical bills (past + future)
  • Lost wages
  • Loss of future earning capacity
  • Pain and suffering
  • Rehabilitation costs
  • Property damage
  • Emotional trauma
  • Loss of consortium
  • Long-term quality-of-life impact

Arizona rideshare accident questions.

The questions we hear most often after Uber and Lyft crashes.

Who pays, and how coverage works

Who pays after an Uber or Lyft accident in Arizona?
It depends on what the rideshare driver was doing at the moment of the crash. If the app was off, the driver’s personal auto policy applies. If the app was on and the driver was waiting for a request, Uber and Lyft provide smaller contingent coverage (typically $50,000 per person and $100,000 per accident for injuries). Once a ride is accepted and until the passenger is dropped off, the companies provide up to $1,000,000 in third-party liability coverage. Identifying the correct period, and getting the right insurer to actually pay, is exactly what we do.
What insurance do Uber and Lyft carry in Arizona?
Arizona law (A.R.S. § 28-4038) requires transportation network companies to carry insurance in tiers tied to the driver’s app status. In practice, both Uber and Lyft provide up to $1,000,000 in third-party liability coverage from the moment a ride is accepted until the passenger exits the vehicle, with smaller contingent coverage while a driver waits for a request. Which tier applies to your crash is often the single biggest fight in the case.
The rideshare driver’s app was off. Now what?
If the driver was offline, they were legally just a regular driver, and their personal auto policy is the primary coverage. Some personal policies exclude rideshare drivers entirely, which can complicate things. If coverage falls short, your own uninsured/underinsured motorist (UM/UIM) coverage may apply. We identify every policy in play and pursue the ones that owe you.

Your situation

I was a passenger in the Uber or Lyft. Do I have a case?
Passengers are almost never at fault, which makes these among the clearest liability cases in personal injury law. Whether your driver caused the crash or another vehicle did, there is insurance coverage designed to compensate you, often the rideshare company’s $1,000,000 policy. The dispute is rarely about fault. It’s about how badly you were hurt, which is where our in-house Medical Professional’s record review makes the difference.
An Uber or Lyft driver hit my car (or hit me walking or biking). Can I make a claim?
Yes. The rideshare tiers protect everyone the driver injures, not just passengers. If the driver was carrying a passenger or en route to a pickup, the company’s liability coverage (up to $1,000,000) can apply to your injuries. If they were waiting for a request, the contingent tier applies. We pull the trip records to prove exactly which one it was.

Deadlines and adjusters

How long do I have to file a rideshare accident claim in Arizona?
In most Arizona personal injury cases, the statute of limitations is two years from the date of the accident (A.R.S. § 12-542). But rideshare cases carry an extra urgency: trip data, app records, and dashcam footage can disappear long before that deadline. The sooner an attorney sends preservation letters, the stronger your case.
Uber’s or Lyft’s insurance adjuster called me. Should I talk to them?
No. Not without an attorney. Rideshare claims are handled by large third-party insurers whose adjusters are trained to minimize payouts, and anything you say is recorded and can be used against your claim. Politely take their name and number, then tell them to contact your attorney.
